The holidays are fast approaching, and are a time to get together with family and friends to celebrate the season. “Unfortunately, they are also a time when drinking increases, which leads to a spike in people driving under the influence,” said attorney Anthony J. However, if you do get pulled over for DUI, Mallo lists the following five tips on what you should do:

No. 1: Don’t resist arrest. “If you do, the police will add more serious charges,” stressed Mallo. “Also, instead of having your car towed, ask if someone can come pick it up. The police are more likely to allow this if you’re not being difficult.”

No. 2: Think before refusing to take a breathalyzer. “Since Florida has implied consent, refusing to take a breathalyzer will result in mandatory license suspension,” said Mallo. “However, your license will not be suspended if you were stopped unlawfully, meaning the police did not have probable cause. This is something an experienced DUI lawyer can assist in determining.”

No. 3: Be prepared to wait. “If you’re picked up on a holiday weekend for DUI, you probably won’t go before a judge until after the holiday,” added Mallo.

No. 4: Consider bail bonds. “If you do not want to wait in jail, look into bail bonds,” said Mallo. “Unlike the courts, bail bonds offices are open 24/7, 365 days a year, so a friend or loved one can post bail on your behalf.”

No. 5: Get a lawyer experienced with DUIs. “An experienced attorney is less likely to just take the easiest guilty plea deal,” concluded Mallo.
